Costolo: Advertising Is Key, Promoted Tweets In Stream Coming Everywhere, Including Third-Parties

photoToday at Twitter's headquarters in San Francisco, CEO Dick Costolo sat down with some members of the media to talk a bit about the state of the company. He rattled of plenty of stats, and also gave the all-important update on the state of the business. Of note, Costolo confirmed that Twitter is in the process of rolling out Promoted Tweets in the stream to everyone ? whether you're following a particular advertiser or not. And that doesn't just mean on Twitter.com (where this roll-out is starting), these Promoted Tweets will be going everywhere Tweets flow, Costolo says. Yes, that means not only Twitter's own mobile apps, but third-party services as well.

Auslogics Disk Defrag 3.2 gets smarter, faster

auslogics defrag
Auslogics Disk Defrag has been part of my system maintenance toolkit for quite some time. With the release of version 3.2, it's now even better at tidying up and optimizing your system's hard disk drives. In addition to a cleaner, easier-to-use interface, Disk Defrag 3.2 offers improved single file and folder defragging, better processing of multiple disks, a simplified scheduling screen, and more informative tool tips. Auslogics has also fine-tuned the program's defragmentation and file consolidation algorithms.

For laptop users, there's a new option to lock the program if your system is running on battery power -- so scheduled operations don't kick in and drain your power source at an inopportune moment. If you happen to have an SSD installed in your PC, you can head to the Disk Defrag options and exclude it from scanning (many think that defragmenting an SSD is a very bad idea).

Auslogics Disk Defrag is a free download and works with most versions of Windows.

Objective-C rocketing up the TIOBE charts

The TIOBE index is a chart of what have been rated as the most popular programming languages in the world, according to various searches online, the number of experts in those languages, and even software output (though it is very certainly not a strict chart of "most lines written"). Obviously, it can't be perfect, but it's at least a very simple indicator of what kinds of computer languages developers are using at any given moment.

Look what has appeared at spot number 6: Good old Objective-C, the language that Mac and iOS developers use to code Mac and iOS apps. Mac and iOS development are gaining in popularity lately, thanks to both the Mac and iOS App Stores, and lots of developers are either jumping in to Objective-C development for the first time, or deciding to flex their coding muscles even more (often by leaping into the iOS fray).

This chart shows just how phenomenally Objective-C is growing lately -- just since 2009, developers have started flocking to the platform in droves. That's pretty amazing. Part of it, of course, is that Apple has poured a lot of resources and development time into building up Objective-C and Xcode alike, but I don't think you can overestimate just how powerful the growth of the App Store as a distribution platform has been for Objective-C and its apps.

Forget Wiretapping Laws, Now You Might Be Able To Use Copyright Law To Stop Anyone From Recording You Ever

There was a recent ruling in a copyright dispute between Swatch (the watchmakers) and Bloomberg that could have troubling implications concerning wiretapping issues. Effectively, it presents a blueprint for how to use copyright law to block otherwise perfectly legal recordings. At issue was that Swatch held an analysts call, as most public companies do regularly. It's pretty standard for various financial firms to push out transcripts of such calls and to report/analyze them. In this case, Bloomberg recorded the call and offered a transcript to its subscribers. Pretty standard stuff. But... here, Swatch claimed copyright on the call. Why? Because they also recorded it (via a partner company), and since that recording was "fixed," they could claim that it was covered by copyright, and then sued Bloomberg.

This ruling was on a motion to dismiss from Bloomberg, which the judge rejected, claiming that Swatch properly established that it had a valid copyright in the recording. It also declined to rule on the fair use claim at this point, though one hopes that, at a later stage, the fair use argument gets a stronger hearing.

The real problem with this ruling is what it could mean when you think about the consequences. As Paul Alan Levy notes, this appears to expand copyright law "far beyond its intended scope." Think about it for a minute. It means that as long as you record yourself while doing something, you can stop anyone from (a) recording you or (b) quoting you, if they quote an amorphous "too much" of what you said in the recording. It's not hard to see scenarios where this is problematic.

Most obviously, at a press conference (which this Swatch call was quite like), a reporter, who pulls out his or her recorder, could be violating the copyright of whoever is holding the conference. Furthermore, if in the process of reporting on the conference, they quote too much of what was said... well, they could face copyright infringement claims.

But let's take it a step further. We just reported on the Massachusetts ruling that said that recording the police was legal. But... what if the police also recorded themselves... and then claimed copyright on that audio. According to this ruling, it's possible that the copyright would be considered legit, and then you'd have to go to court to argue the fair use claim.

That's clearly not what copyright law is intended for, but it's a very real implication of this ruling.

Apple hiring new product security managers

Last week, a CNET report kicked off the wild tale of a lost iPhone 5. This baffling story tracked the phone from a bar to an apartment in San Francisco. It even included a controversial search conducted by Apple security employees with the San Francisco police department. Though this is an entertaining tale for the technophile, there may be more going on behind the scenes at Apple.

On Thursday, when these reports of the lost iPhone 5 were circulating, Apple posted two job listings for product security managers. According to the job listings spotted by PC Magazine, the new hires "will be responsible for overseeing the protection of, and managing risks to, Apple's unreleased products and related intellectual property."

From the description, it appears that Apple wants to make sure they don't lose track of the iPhone 6 like they did with the iPhone 4 and (supposedly) the iPhone 5.
